“When you were standing 3-5 feet from him (Kyle Rittenhouse) with your arms up in the air, he never fired… right?” Asked a member of the Rittenhouse defense team.

“Correct”, Grosskreutz hesitantly responded.

“It wasn’t until you pointed your gun at him (Rittenhouse), advanced on him with your gun (inaudible) pointed at him, that he fired.. right?” The defense attorney asked

“Correct” Grosskreutz responded, burying his case against Kyle.

Kyle’s attacker also admitted that the 4th Gen Glock 27 handgun that he had on that night was illegally possessed.

He admitted when asked by both the prosecution and the defense, that he did not have an active concealed carry permit that would allow him to carry the handgun.

The defense has successfully proven that Kyle did not discharge his weapon at any person who was not posing a threat of grave bodily harm to his person.
