Federal Judge Rules In Favor Of Biological Men In Female Prisons

A democrat-appointed judge has opened the door for more biological men to serve their sentences in exclusively female prisons. 

The daily caller reported, A Democrat-appointed judge (Diana Gribbon Motz appointed by Clinton) ruled that the Americans with Disabilities Act (ADA) applies to individuals with gender dysphoria, meaning transgender people will now be protected by the ADA.

The ruling comes after a biological male named Kesha Williams sued the Fairfax County Adult Detention Center in Virginia for violating the ADA during Williams’s incarceration. 

Williams claimed to have experiences harassment by male inmates, which tends to happen regardless of gender orientation while in prison. 

Gribbon Motz tore down a lower court ruling that dismissed the lawsuit altogether. Prisons don’t function on gender. When you are processed by the government you fall into one of two biological sexes. If you are being incarcerated your sex determines where you will be held. 

Candice Jackson, attorney and former assistant U.S. secretary of education for civil rights told the Caller that it’s unclear how allowing biologically male inmates in female prisons would work in practice. 

“Recognition of gender dysphoria as a disability under the ADA is not inherently problematic; depending on the severity of distress and how it manifests, objectively GD can be easily seen as a disability on par with any number of other conditions,” she said. 

This isn’t entirely true, Transgender inmates have already begun causing massive issues for female prisons.

The women at Edna Mahan Correctional Facility became pregnant after “consensual sexual relationships with another incarcerated person,” Dan Sperrazza, the Department of Corrections’s external affairs executive director, told NJ.com.

The correctional facility in Clinton has faced a long list of sexual assault scandals and Gov. Phil Murphy announced plans last year to close it down.

Sperrazza told the Daily Mail, “While DOC cannot comment on any specific disciplinary or housing decisions that may be considered in light of these events, the Department always reserves all options to ensure the health and safety of the individuals in its custody”.

Last year, as a result of a lawsuit, New Jersey enacted a policy to allow prisoners to be housed in accordance with their preferred gender identity.

This begs the question. Why should prisoners be given “preference”? Criminals aren’t even afforded the right to vote, or move freely in the world.. 

why suddenly should they get to choose where they’re housed?  

The suit was brought forth by a trans inmate in men’s prisons and the American Civil Liberties Union of New Jersey.

According to NJ.com, there are currently 27 inmates who identify as transgender in the prison that houses more than 800 inmates.
