The Materiality Provision stipulates that one’s voting rights cannot be denied on the grounds of an ‘error or omission’ on administrative papers ‘related to any application, registration, or other act requisite to voting’, provided the blunder is ‘not material in determining whether [an] individual is qualified’ to cast their vote. In essence, if a mistake does not seriously hamper the eligibility assessment of a voter, then it should not obstruct their right to participate in the democratic process.
Counteracting, the RNC advanced its belief that enforcing the date necessity on a ballot ‘does not impinge on the right to vote.’ Their standpoint, as reported by The Daily Wire, contended that the Materiality Provision bears relevance only to ‘immaterial requirements affecting the qualification and registration of a voter,’ rather than the more precise requisites applicable when actually casting a ballot.
Two out of the trio of judges, all of whom were appointed by Democrat presidents within the appeals panel, aligned with the Republican defense. They accentuated the fact that each stage of the voting process is governed by distinct rules and regulations. The voter qualification stage, for instance, determines who has the right to vote, not unlike the process of gaining a driver’s license. In order to gain authorization to vote, an individual must adhere to specific steps and meet certain expectations.
Subsequently, once the individual is authorized to vote, the manner in which his or her ballot is cast is overseen by an altogether separate set of rules. The process to cast a valid, countable ballot entails adhering to specific requirements. This analogy applies to how people authorized to drive must comply with the State’s traffic laws.

RNC Chairman Michael Whatley celebrated the ruling by the 3rd Circuit Court of Appeals calling it a ‘key victory for election integrity and voter belief in the Keystone State, and across the nation.’ He emphasized that Pennsylvanians should have every confidence in the security of their mail ballots. Whatley was critical of ‘unlawful left-wing attempts to count undated or incorrectly dated mail ballots’ and expressed the Republican commitment to uphold electoral integrity in courts nationwide before the upcoming 2024 election.
Following this ruling, the RNC declared, ‘In November 2022, the RNC, NRCC, and PAGOP emerged victorious on this issue in front of the Pennsylvania Supreme Court. However, a federal district court overturned the mandated signature dating in November 2023. We appealed this, and now the U.S. 3rd Circuit Court of Appeals has concurred with the argument of the RNC.’
